A previous marriage does not prevent someone from applying for a K-1 fiancé visa. It does, however, create an important part of the applicant’s history that must be properly documented and may come up during the consular interview.

For couples in Naperville, Schaumburg, Chicago, and surrounding Illinois communities, preparing for that interview means looking beyond the current engagement.

If either partner was previously married, the dates, documents, and relationship timeline should make clear that both people were legally free to marry when the K-1 petition was filed.

Why Do Prior Marriages Matter in a K-1 Case?

The K-1 visa allows a foreign-citizen fiancé of a U.S. citizen to travel to the United States to marry the petitioner within 90 days of arrival.

Both partners must have been legally free to marry when Form I-129F, Petition for Alien Fiancé(e), was filed and must remain legally free to marry. If either person was previously married, that means the prior marriage must have legally ended.

U.S. Citizenship and Immigration Services (USCIS) requires evidence showing the termination of previous marriages, such as a final divorce decree, annulment, or death certificate issued by a civil authority.

What Should You Bring to the Consular Interview?

An approved petition does not eliminate the need to document prior marriages during the visa process.

The U.S. Department of State instructs K-1 applicants to bring divorce or death certificates for previous spouses of both the foreign-citizen applicant and U.S. citizen petitioner.

Applicants also need other required civil documents and evidence of the relationship. The specific U.S. embassy or consulate may have additional instructions.

Before the interview, applicants should review documents for issues such as different spellings of names, inconsistent dates, incomplete divorce records, or foreign documents that may not satisfy the applicable requirements.

Be Prepared to Explain the Relationship Timeline

A consular interview is not simply a document drop-off. The officer adjudicates the K-1 visa application and may ask questions about the couple’s eligibility and relationship.

When a prior marriage is part of the history, questions may address when that relationship ended and when the current relationship began.

The officer may also explore how the couple met, how the relationship developed, visits with one another, wedding plans, or other facts relevant to whether the relationship is genuine.

No single list of questions applies to every K-1 applicant. What matters is being prepared to answer truthfully and consistently with the information already provided in the petition and visa application.

Complicated Marital Histories Deserve Extra Preparation

Multiple prior marriages, foreign divorces, unusual timelines, missing civil records, or uncertainty about whether a divorce was legally final can require more than ordinary interview preparation.

The Department of State specifically advises applicants that civil documents must come from the appropriate official issuing authority.

If you question whether a previous marriage was legally terminated, it is better to identify it before the interview than to discover the problem while sitting across from a consular officer.
