In Need of an F1 Student Visas & Consular Processing Preparation Lawyer?

An F1 Visa is a non-immigrant visa issued to international students who wish to study in the United States. It is granted to those enrolled in an academic program at an accredited U.S. educational institution, such as a college, university, conservatory, or high school.

However, before the visa is granted, the first step is to apply to and be accepted by a U.S. school certified by the Student and Exchange Visitor Program (SEVP), pay the necessary fees, complete the DS-160 Form, and schedule and attend a consular processing interview.

During the interview, the consular officer will ask about your academic plans, financial situation, and intentions for studying in the U.S. The goal is to determine whether you meet the requirements for an F1 Visa. After the interview, the consular officer will approve or deny your visa.

The exact number of F1 visa denials is not consistently published in real time. Still, historical data and trends from the U.S. Department of State give a general idea of visa approval and denial rates. Historically, the global denial rate for F1 visas has ranged between 20% and 35%, making the consular interview one of the most critical steps in the F1 visa process.

By partnering with Kasturi Law, LLC, applicants receive comprehensive support through each stage of the F1 student visa process, from initial application to visa interview preparation, increasing their chances of studying in the U.S.

What Steps Are Involved in U.S. Immigration Consular Processing?

The first step in consular processing is determining if you can apply for a Green Card. Most immigrants become eligible through a petition filed on their behalf by a family member or employer. Others become permanent residents by obtaining refugee or asylum status or through several other special provisions.

When you know what category you believe best fits your situation, you will need someone—the petitioner—to file the immigrant petition. U.S. Citizenship and Immigration Services (USCIS) notifies the petitioner of a decision.

If the petition is approved and you live outside the United States, USCIS will send it to the U.S. Department of State’s National Visa Center (NVC). The petition will remain there until an immigrant visa number is available for you.

From there, you will:

  • Wait for Notification from the National Visa Center

The NVC will notify the petitioner and you when the visa petition is received and again when an immigrant visa number is about to become available. They will inform you when you must submit immigrant visa processing fees and supporting documentation.

  • Document Submission and Processing

The DS-260, also known as the “Immigrant Visa Electronic Application,” is an online form used by individuals applying for an immigrant visa at a U.S. embassy or consulate abroad. It is a critical step in the consular processing of immigrant visa applications.

The DS-260 collects biographical information, background details, and other relevant information from individuals seeking to immigrate to the United States. It includes sections for providing personal information, family details, employment history, educational background, and information about the intended immigration to the United States.

In addition to completing the DS-260 form, applicants may be required to submit supporting documentation, such as birth certificates, marriage certificates, Police Clearance Certificate (PCC), and other relevant records.

In addition, medical examinations are an essential component of the immigration process. Immigrants applying for immigrant visas through consular processing usually undergo a medical examination before attending the immigrant visa interview at a U.S. embassy or consulate abroad.

It is imperative that the medical examination is completed and that all information contained in the DS-260 is accurate and complete to avoid any delays, requests for information, or potential denials. The form is completed and submitted electronically through the Consular Electronic Application Center (CEAC) website, which the U.S. Department of State operates.

Once all required documents are submitted and processed, the case is transferred to the U.S. embassy or consulate in the individual’s home country.

  • Interview Appointment and Visa Issuance

Once a visa is available or your priority date is current, the consular office will schedule you for an interview. It is impossible to overstate the importance of attending your initial interview, as rescheduling can lead to significant delays in the process.

During the interview, a consular officer will review your eligibility for the immigrant visa and determine if you meet all legal requirements. If approved, you will receive an immigrant visa to travel to the United States and become a lawful permanent resident.

  • After Your Visa is Granted

If you are granted an immigrant visa, the consular officer will give you a packet of information known as a “Visa Packet.” Do not open this packet. You will need to pay a USCIS Immigrant Fee. USCIS uses this fee to process your immigrant visa packet and produce your Green Card.

When you arrive in the United States, you should give your Visa Packet to the U.S. Customs and Border Protection (CBP) officer at the port of entry. The CBP officer will inspect you and determine whether to admit you into the United States as a lawful permanent resident. If the CBP officer admits you, you will have lawful permanent resident status and can live and work in the United States permanently.

  • Receive Your Green Card

If you have paid the USCIS Immigrant Fee, you will receive your Green Card in the mail after you arrive in the United States. If you did not pay the USCIS Immigrant Fee before you came to the United States, you will need to pay the fee before USCIS will send you a Green Card.
