Can I Apply for a Green Card While in the United States on a Visitor or Student Visa?

In most cases, individuals who are in the United States on a Visitor Visa (B-1/B-2) or a Student Visa (F-1) are not eligible to directly apply for a lawful permanent residency (Green Card) while they are in the United States.

However, there are some exceptions and alternative pathways to obtaining a green card while in the United States on a nonimmigrant visa:

Adjustment of Status (AOS)

In certain circumstances, individuals who are lawfully present in the United States and meet the eligibility criteria may apply for adjustment of status (AOS) to obtain a green card without leaving the country.

Common eligibility categories for AOS include:

  • Immediate relatives of U.S. citizens, including spouses, unmarried children under 21, and parents of U.S. citizens).
  • If eligible, specific employment-based immigrant categories and a visa number are immediately available.
  • Asylum seekers who have been granted asylum or admitted to the United States as refugees.

Marriage to a U.S. Citizen
